Medical expert evidence. England and Wales.

Clinical opinion a court can rely on. The machinery that gets it there on time.

An independent panel of medical experts, providing reports and assessment clinics across a range of clinical specialties, with particular depth in military and veteran claims and in environmental injury.

Make an enquiry

What we do

Duty to the court

The expert's duty is to the court, and it overrides any obligation to the person instructing or paying.

CPR 35.3

Independent

Instructed by claimant and defendant alike. We decline where a conflict exists, and say why.

Expert led

Trained, governed and hand selected. Expert witnesses drawn from careers of senior practice in their own fields.

Services

Expert reports

Compliant with CPR Part 35 and Practice Direction 35, and written to answer the question actually asked. Preliminary and screening opinions where you need to know quickly whether a claim is worth running.

Assessment clinics

Face to face examination with the report written from it. Where a group of claimants shares an index event or an alleged mechanism, we run it as a scheduled clinic programme.

Medico-legal administration

Records retrieval and sorting, bundle preparation, booking, chasing and invoicing, by a team that already handles service personnel medical records under Ministry of Defence contract. For instructing firms and insurers.

What a report can address

Breach of duty
The standard of care at the time, without hindsight. The Bolam test, as qualified by Bolitho, and consent following Montgomery. Given only where the care falls inside the expert’s own field and current practice, and we say so at the outset where it does not.
Causation
Factual causation on the but for test, material contribution to injury, and apportionment across competing causes and pre-existing conditions.
Condition and prognosis
Prognosis with and without treatment, the effect on function, employment and daily living, recommended treatment and its likely cost, and care and assistance needs.
After the report
Part 35 questions within the deadline, discussions and joint statements under CPR 35.12, single joint expert instructions, conference with counsel, court attendance and cross examination.

Military and veteran claims

A service or veteran claim needs a clinician who knows how the medical record was made, what a board was deciding, and what the injury pattern of service life looks like.

Collectively our experts have served through the British operations of the last three decades. Their Defence and veteran work continues: medical records, casework and appeals under a Ministry of Defence contract, a regional clinical lead role in the NHS veterans’ physical health and wellbeing service, and direct experience of how Defence sets and audits the clinical standards a military breach of duty opinion is measured against.

Environmental injury

Injury caused by cold, heat, altitude and immersion, whether in military training and operations, expedition and adventure travel, or at work.

Between them the panel holds a seat on the UK working group on frostbite and non-freezing cold injury, twenty years of medical directorship of deep field Antarctic operations, faculty on the UK Diploma in Mountain Medicine, and the editorship of the polar medicine section of Auerbach’s Wilderness Medicine. Not every expert on the panel takes this work, and we match each instruction to an expert whose field it falls inside.

Scope. We work in England and Wales only, and do not undertake MedCo soft tissue reporting. Where a case falls outside what we can properly opine on, you will hear it at the letter of instruction stage.

What we declare. Some of our people hold current or former connections with Defence, and ASG Rescue holds commercial contracts with the Ministry of Defence. Each is declared in writing to both sides before papers are accepted, and we decline where it bears on the opinion. Declaring it at the outset puts it on the record before it can become a problem for whoever instructed us.

Leadership team

AJ Alun Jones

Alun Jones

MSc

Practice Director

Alun is the first point of contact for an instructing firm: whether we can take the case, the cost, the timescale, and the conflict check run before any papers are accepted.

He is not a clinician and gives no clinical opinion. Thirty years of operational leadership in military and commercial security, including investigations instructed by law firms.
